Delta Attorney General drags before Legal Practitioners Privileges Committee, alleges of aiding release of criminals

Nigeria, Delta – A former Minister of State for Education, Olorogun Kenneth Gbagi, has dragged the Delta State Attorney General, Peter Mrakpor before the Legal Practitioners Privileges Committee alleging him of using his office to secure the release of suspected notorious kidnappers, assassins already apprehended by the police in Delta State.

The allegation was contained in a petition dated 5th October, 2020, and addressed to the Secretary, Legal Practitioners Privileges Committee, Supreme Court of Nigeria.

In the petition, Olorogun Gbagi also appealed to the Committee for the sake of the sanctity of the legal profession to refrain from conferring the rank of Senior Advocate of Nigeria, SAN, on the AG, Barr. Peter Mrakpor as doing so will amount to gross injustice which cannot be remedied, which could also lead to mayhem and violence of unimaginable proportion in Delta State.

The former minister further said the Attorney General through a Nolle Prosecui – No case submission – was alleged to have  released a total of 150 criminals in the custody of the Police after receiving various sums of money.

PETITION AGAINST BARR. MRAKPOR PETER – ATTORNEY GENERAL OF DELTA STATE NGERIA FOR UNWORTHY PRACTICES, ABUSE OF POWERS, INSTIGATING COMMUNAL CRISIS IN SEVERAL COMMUNITIES AND HIS RELENTLESS ASSAULT ON THE FRAGILE LIMBS OF JUSTICE IN DELTA STATE.
INTRODUCTION
My attention has been drawn to your Notice/Press Release of 24th day of September, 2020. It is on that premise that I write to intimate you on the unprecedented display of impunity, corruption and administrative rascality by Barr. Peter Mrakpor, the Delta State Attorney- General.
FACTS
While it is not in doubt that, the powers granted to the Attorney General of the state by section 211 of the Constitution of the Federal Republic of Nigeria 1999 as amended are not without limits, such powers must be exercised in line with the overall good of the public. It is however my utmost dismay to discover that the A. G of Delta State aforementioned has colluded and connived with Armed Robbers, murderers, assassins and kidnappers on numerous occasions to terrorize the entire Delta State populace. As written and published in ECONOMIC CONFIDENTIAL of May 4, 2020 in an article titled “a cry for help; why Federal Government must intervene to rescue Delta State from Kidnappers” by Omatsola Tosan, an activist, between 2015 and 2020 Peter Mrakpor is alleged to have relied on Nolle Prosequi to effect the release of 150 suspected criminals apprehended for serious crimes ranging from murder to kidnapping. The number remains the highest in Nigeria as a whole. It is a fact on record that the Delta State Attorney General has released arms robbers, kidnapers, assassins, murderers with the use of his powers conferred by the constitution for sums of money ranging from N2,000,000 (Two Million Naira) to N30,000,000 (Thirty Million Naira) depending on the gravity of the offence. The said article is herein attached and marked as Annexure I.
In the case of State V Stella Odozi which was pending at the High Court Umunede Delta State before Hon. Justice Celestina Dafe, a group of hardened armed robbers who had been terrorizing the community, killing several persons and carting away valuable properties met their waterloo and were apprehended by the Police and eventually arraigned in court. Upon arraignment, the Delta State Attorney-General upon receipt of an undisclosed amount of money wrote an opinion stating that these hardened criminals who were well known as such had no case to answer thereby exonerating them. This was particularly troubling as several of the culprits had confessed to various crimes in their statements to the Police. Despite the above, the Attorney-General (Peter Mrakpor) instructed their release.
Their release did not go down well with the complainant in that case who wrote a petition as to why the culprits cannot be left unpunished. It was on this premise that the same Delta State Attorney-General (Peter Mrakpor) turned, somersaulted and wrote another opinion stating that the suspects had a case to answer. Unfortunately, the suspects had been released and absconded. All efforts by the Police to apprehend these criminals thereafter proved abortive till date.
It is a notorious fact that Delta State as result of the acts of Peter Mrakpor with regards to his association with criminals has lost its glory as investors have left the state and everybody going about sleeping with one eye open.
This is the reason for the collapse in the economic and social life in Delta State as evident to the world hence my interest as the most prominent investor in the State.
Mrakpo uses his Law firm to defend this notorious criminals thereby acting in dual capacity as the prosecuting counsel and defence counsel.
Another one of such sad, unfortunate and pitiable cases occurred in Oginibu Community, Ughelli South Local Government Area of Delta State.
On the 12th of December, 2019 one Fidelix Daniel Gbugo was stabbed to death in Oginibu community by Elvis Chukwusagba, Thank God Pela, Sunday Bamrese, Thomas Bamrese, Richard Brede, Moses Djeba, Alex Bushell, Adila Sajini. The Chief Magistrate Court sitting in Ibusa on the 27th of December had remanded Adila Sajin, Futuku Bright, Moses Djabah and Alex Bushel at the Ogwashi-Ukwu Prison over the murder of Fidelix Daniel Gbugo by virtue of Police application for the assumption of Jurisdiction. The suspects were remanded following a thorough police investigation which revealed that the suspects murdered the late Fidelix Daniel Gbugo who was confirmed dead at General Hospital Otu-jeremi after he was severally stabbed at his neck and waist. Sources have alleged that Okius Diavwokonrue, Dora Jukolemu and others who were also involved in the murder of the said deceased are all at large The said suspects on remand and their political allies boasted with their influence at the office of the Attorney General whom they were optimistic will give a “No case to answer” to that effect.
However, to our uttermost shock and true to their boasting the Attorney-General (Peter Mrakpo) gave a No Case in his legal Advice and the accused persons were released accordingly. It was also gathered that these same persons were also involved in inflicting similar grievous harm on one Mr. Victor Mawarita who was also rushed to General Hospital Otu-jeremi on the 6th of October 2019 and a complaint was lodged to that effect at the Divisional Police Headquarters Otu-jeremi.
The crisis in Oginibu community in Ughelli South has been at their instance and efforts to put them on check has been a tug of war due to their political aid.  The father to the deceased Mr. Ogbogo Daniel has lamented over the intimidation he suffered while pursuing Justice for his family.
This presents a very unjust situation as the law is trite that justice is a three way traffic i.e. justice for the State, justice for the accused and justice for the victim of the offence. In this Scenario, Justice was not served as the deceased victim whose body still lies in the mortuary and cries out for his murderers to be made to face the law. His bereaved father still seeks answers as to why the persons who murdered his son in cold blood cannot be brought to face the full weight of the law and walk freely. The said deceased victim’s picture is herein attached and marked as Annexure II.
Further to the death of Fidelix Daniel Gbugo, this three persons namely, Victor Mawerienta, Kporis Tebu and Mwamama whose pictures herein attached and marked as Annexure III were equally attacked, severely injured and stabbed.
It is pertinent to state at this point that, the same scenario would have played out again in Idumuje – Ugboko community of Aniocha North Local Government Area of Delta State where Prince Nonso Nwoko was implicated in the murder of two persons and a reign of terror and violence where several persons were killed and valuable properties destroyed via a petition written against him.
The Attorney-General attempted yet again to quench the ready gun fire of justice by refusing to accept the order of the Chief Magistrate F. Obonodo to remand the Prince and several others persons in Prison custody. Not only did he push for their release, he also attempted to influence the learned Chief Magistrate to make a report that there was no evidence against the Prince and his cohorts despite overwhelming evidence to the contrary. Justice was however served as the case was subsequently transferred to the Federal High Court, Abuja wherein it is currently pending in charge No. FHC/AB/CR/11/2019.
Furthermore, all over the social media last week the same Peter Mrakpor has been announcing and misleading the public that he has two persons in the Legal Practitioners Privileges Committee who have guaranteed him success on his conferment as a Senior Advocate of Nigeria (SAN) and he has since been receiving congratulatory messages.
The few instances mentioned above and many more amount to a disdainful abuse of official position and crass violation of legal ethics being perpetrated by the Attorney-General of Delta State. It is on the aforementioned grounds and others too numerous to mention that I appeal to you for the sake of the sanctity of the legal profession that you refrain from conferring the Rank of Senior Advocate of Nigeria on Barr. Peter Mrakpor as doing so will amount to gross injustice which cannot be remedied and also lead to May hem and violence of unimaginable proportion in Delta State.
In view of the foregoing and with sense of responsibility, I unequivocally invite you to consider this petition whist looking into Mr. MRAKPO’s application for the rank of a Senior Advocate of Nigeria (SAN).
